Terms and Conditions

§1 General
0. Definition: TaC = Terms and Conditions.
1. For the business relation between Shabster.net/Shabster.org and the visitor respectively the customer the Terms and Conditions displayed on Shabster.net/Shabster.org are applicable. The latest version of the Terms and Conditions at the time of an order is valid.
2. Registration on Shabster.net/Shabster.org is for free.
3. The data and information which is needed for registration must be filled in correctly and thruthfully.
4. Other Terms and Conditions of the customer are not accepted by Shabster.net/Shabster.org, unless Shabster.net/Shabster.org explicitly agrees to their validity.
5. Severability clause:
If a provision of this Agreement is or becomes illegal, invalid or unenforceable in any jurisdiction, that shall not affect:
a. the validity or enforceability in that jurisdiction of any other provision of this Agreement; or
b. the validity or enforceability in other jurisdictions of that or any other provision of this Agreement.
6. The TaC affect the usage of the website Shabster.net/Shabster.org and all its subdomains. This also applies to our designated parter sites.
7. The language of this contract on Shabster.net/Shabster.org is German. Translated versions of this and other documents are just made for understanding but are not legally binding. Therefore only the German version of the TaC and other texts are legally binding.
8. Data communication via the internet at the current state of technology can't be guaranteed to be free of errors and/or available constantly. Therefore we don't guarantee the availability of Shabster.net/Shabster.org and all its subdomains at all times.
9. Shabster.net/Shabster.org is only aimed at adults, i.e. minimum age of 18 years. The offered products are only allowed to be acquired and/or viewed by adult persons.
10. No responsibility is taken for the correctness of product information or descpritions displayed on Shabster.net/Shabster.org. There are no exceptions unless they are explicitly accepted by us.
11. British Law under exclusion of UN Law is applicable. This agreement is also valid in case an order is made outside the United Kingdom and Norhtern Ireland and/or the delivery is made to a country or state that is outside the United Kingdom and Northern Ireland.
12. The website is operated by Shabster.net/Shabster.org. Pictures, illustrations, product names, brands and names protected by copyright, and others are property of their respective owners.
§2 Order process and product related issues
1. Shabster.net/Shabster.org does not require a minimum order.
2. Only prices at the time of the order are applicable. All prices include the current valid VAT.
3. Payment/Ordering of products are currently only possible via Sofortüberweisung, Paypal and Bank Transfer.
4. Shabster.net/Shabster.org reserves the right to cancel or decline orders. In case Shabster.net/Shabster.org does not fulfill an order, Shabster.net/Shabster.org will inform the customer within a time frame set by Shabster.net/Shabster.org.
5. Before an order is dispatched Shabster.net/Shabster.org allows its registered customer to recheck the order details ( e.g. price, billing address, payment method, quantity ) and if necessary or wanted to correct them.
6. In case of late payments by the customer Shabster.net/Shabster.org reserves the right to charge default interests of 5 % p.a. above the current basis interest rate set by the European Central Bank. If the damage caused by late payments is higher than the default interests Shabster.net/Shabster.org reserves the right to demand damages.
7. The order is accepted by sending an email confirmation of the order or by delivering the order. Shabster.net/Shabster.org reserves the right to accept the order within two weeks after receiving the order.
8. The offered products can be European, American, Asian or German versions. Booklet and/or covers can be in German or in English or in any other language.
9. If a product is not available, Shabster.net/Shabster.org reserves the right to offer the customer a replacement that is equal in quality and price. The customer has the right to decide whether he or she wants to accept or decline this offer.
10. The purchasing price is due at the moment Shabster.net/Shabster.org accepts the order. This payment must be carried out under the conditions at the time of the order.
11. Product illustrations and product descriptions can vary from its original.
12. The displayed prices of the products do not include delivery and posting costs.
13. Shabster.net/Shabster.org reserves the right to cancel parts of an open order if false information regarding the creditworthness of the customer was given and/or objective arguments about the customer's insolvency are indicated.
14. Damages, which are caused by the customer by improper setup, connection, usage or storage, do not substantiate a claim towards Shabster.net/Shabster.org.
15. Prices displayed in Swiss Francs (CHF) and/or British Pounds (GBP) are only an orientation. Only prices displayed in Euros (EUR) are applicable.
§3 Shipment
1. Delivery and posting costs have to be paid in full as outlined during the ordering process.
2. The delivery of a product is fulfilled as stated on the product page. This delivery time is just an estimate.
3. Delivery costs are charged per item unless otherwise agreed in written form.
4. In case the product is in a not obviously damaged condition prior to delivery, Shabster.net/Shabster.org pays the returning costs. The returning costs may not exceed the initial delivery costs to the customer. In case of exceeding the initial delivery costs the customer has to pay for the difference.
5. Shabster.net/Shabster.org only ships products within Europe. For deliveries outside of Europe a separate agreement in written form has to be agreed upon.
6. The product is property of Shabster.net/Shabster.org until it is fully paid by the customer.
7. If a delivery time frame is given and if it's part of an order, the delivery time frame is extended by the delay in case of strike or other cases of force majeure. The same is applied in case the delay is caused by the customer's failure to adhere to his obligation to co-operate.
8. Delivery to certain countries and/or states can cause additional tariffs, taxes and/or costs, which are not included in the purchasing prices. The customer has to pay for those costs.
9. Shabster.net/Shabster.org reserves the right to demand compensation for damages caused by the customer's default of acceptance and/or other failure to adhere to his obligation to co-operate.
10. Shabster.net/Shabster.org does not wish for any business with persons under the age of 18. The customer has the obilgation to make sure that only he or an appointed person not under the age of 18 receives the delivery.
11. The delivery will be made to the shipping address given by the customer.
12. Shabster.net/Shabster.org is not liable for missed profits or any other economic loss of the customer.
13. Shabster.net/Shabster.org reserves the right to make partial deliveries. No additional costs are charged for this.
14. Products which aren't released yet cannot be dispatched before the release date displayed on the product site (preorder). In case the release date is changed by the publisher the new release date applicable.
§4 Returning of Products
1. The customer has a 14-days money-back guarantee unless the product is damaged or not sealed anymore. I.e. the customer can give back the ordered product in written form (e.g. eMail, letter, fax, etc.) without giving a reason and by sending back the product, if the product is still in a sealed condition.
2. The respite starts with the arrival of the ordered product. In order to meet the revocation period it's sufficient to send the recovation and the ordered product in time.
3. Returning products without prior contact (e.g. via eMail) cannot be accepted.
4. The limitation period is twentyfour months, starting from the date of delivery.
5. Non-essential damages which only have minor effects on the usability are excluded from our warranty. Compensation for immaterial damages are excluded too.
6. In case the return of an item is not part of our provided guarantee, the customer has to pay for the returning costs.
§5 Privacy
1. All information provided by a customer is treated highly confidential by our high privacy standard.
